2 Acceptance of the Terms
By accessing the Website and/or purchasing any service, the user (the “Client”) unconditionally agrees to be bound by these Terms and Conditions of Sale and Use (the “Terms”). These Terms constitute a binding agreement and override any other document or verbal communication.
3 Scope of Services
Marketor offers customized digital services, including but not limited to:
The design and delivery of custom-built websites (e.g., using Framer);
The creation and configuration of AI-powered conversational agents.
These services are bespoke and provided under a best-effort basis (obligation of means), with no guarantee of results.
4 Orders – Payments – Cancellations
Orders are final and non-refundable once confirmed and paid.
All prices are listed excluding taxes, unless otherwise stated.
Payment is made securely online using accepted methods.
Marketor reserves the right to reject or cancel any order at its sole discretion.
No work shall commence before full payment has been received.`
5 Client Responsibilities
The Client agrees to:
Provide all necessary content, instructions, and materials in a timely and accurate manner;
Ensure that any content submitted is lawful and free from third-party rights;
Assume full responsibility for supervising the use of any AI agent delivered;
Refrain from using any deliverable for unlawful, deceptive, harmful, or regulated purposes (e.g., medical, financial, or legal) without human oversight.
Marketor will not be liable for any damages arising from misuse, negligence, or failure to review AI behavior before deployment.
6 Delivery & Timeline
Delivery timelines are indicative only and may be extended in cases of Client delays.
A project is deemed delivered upon transmission of the deliverables (e.g., files, access links, or live sites).
The Client has 7 calendar days from delivery to report any technical or functional issue. After that, the work is considered accepted and approved.
7. Revisions and Scope
Each service includes a limited number of revisions, as specified at the time of purchase.
Additional requests, features, or changes beyond the original scope will require a separate quotation.
Marketor reserves the right to refuse any excessive or out-of-scope request.
8. Intellectual Property
All source code, design, structure, and configuration remain the exclusive property of Marketor until full payment is made.
Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the deliverables strictly for business purposes.
Resale, sublicensing, duplication, or redistribution is strictly prohibited without prior written consent.
9 AI Agent Disclaimer
Important Notice Regarding AI Services:
AI agents delivered by Marketor may generate inaccurate, biased, inappropriate, or unpredictable content.
AI tools do not replace professional judgment and must not be used in critical sectors (e.g., healthcare, law, finance) without appropriate human oversight.
The Client assumes full legal, ethical, and operational responsibility for any AI usage.
Marketor will not be held liable for:
AI-generated statements or outcomes;
Actions or decisions made based on AI output;
User complaints, legal claims, or regulatory penalties arising from the use of an AI system.
10 Legal Compliance – Data Protection
The Client is solely responsible for ensuring that their website or AI usage complies with relevant data privacy regulations, including but not limited to GDPR, CCPA, or other local laws.
Marketor delivers technical tools only and shall not be liable for the Client’s failure to implement appropriate privacy notices, cookie policies, or data consent mechanisms.
11 Limitation of Liability
Marketor shall not be liable for:
Loss of revenue, data, reputation, or clients;
Damages caused by third-party services (e.g., hosting, APIs, platforms);
Malfunctions due to Client alterations or misuse;
Business disruptions, data loss, or downtime.
In all cases, Marketor’s total liability shall not exceed the total amount paid by the Client for the relevant service.
12 Force Majeure
Marketor shall not be held liable for any delay or failure due to force majeure or events beyond its control, including (but not limited to): cyberattacks, hosting failure, pandemic, natural disaster, government restrictions, or service outages.
13 Disputes – Governing Law
